القضايا الأسرية بين النص القرآني وآراء الفقهاء (الخلافات الأسرية) نموذجًا

تهدف هذه الدراسة إلى بيان أنَّ قضية الخلافات الأسرية عملية اجتماعية وطبيعية في الحياة الزوجية، ولا تخلو أسرة في مجتمع ما من وجودها، ولکن تختلف درجة هذه الخلافات نتيجة لاختلاف ثقافة کل أسرة وکذلک اختلاف العادات والتقاليد الاجتماعية المسيطرة في المجتمع. کما تهدف أيضًا هذه الدراسة إلى التعرف ومن ثمَّ الوقوف على أنواع الخلافات الأسرية في القرآن الکريم، وطرق علاجها بين النص القرآني وآراء الفقهاء، ومن ثمَّ في الواقع المعاصر.
ومن ثمَّ جاءت هذه الدراسة کإسهام ومشارکة أولية في مجال الدراسات والأبحاث المتخصصة بقضايا الأسرة، ومشاکلها الدينية والاجتماعية والاقتصادية والثقافية الفکرية، وکذلک النفسية والجنسية منها، حيثُ تُعطي مؤشرات ملموسة لبعض القضايا المتعلقة بالعلاقات الأسرية، والتي لا بد من دراستها والوقوف عليها من أجل تحليلها وبيان أسبابها وآثارها الناتجة على الفرد والمجتمع فيما بعد.
وتقوم هذه الدراسة على توظيف المنهج الاستقرائي، وذلک في جمع المادة العلمية، ومن ثمَّ الاستعانة بالمنهج التحليلي من أجل بيان وتوضيح تلک القضية بين النص القرآني وآراء الفقهاء، والواقع.
ومما تقرر في نتائج هذه الدراسة أنَّ الإسلام قد بيَّن من خلال اتباع ضوابط قرآنية تتمثل في أسس الاختيار المناسب لکل من الزوجين على أساس الدين والتقوى والصلاح بديلًا عن الأسس التي لا تضمن للزواج بقائه واستمراريته واستقراره إلَّا المُعايشة الوقتية فقط من أجل استقرار الأسرة، وتحقيق مبادئ السکن والمودة والرحمة بين الزوجين.
کذلک انحسار دور الأسرة التربوي، ومن ثمَّ دورها الاجتماعي في المجتمع الإسلامي والتخلي عن جوانب کثيرة من مسؤوليتها التربوية، والاهتمام ببعض الجوانب الشکلية، التي تتمثل في الجوانب المادية والاقتصادية.
إلى جانب ما خلصت إليه الدراسة من نتائج هامة تتمثل في خطورة القنوات الفضائية، وشبکات الاتصال الحديثة من خلال ما تبثه من برامج إعلامية تفسد الحياة الأسرية والزوجية، وتعمل على انحلال روابط الأسرة بين الزوجين بعضهما البعض، وبين الزوجين وبين الأبناء بعضهما البعض.
وللأمانة العلمية أُصرح بأني لست أول من ولج، أو آخر من يلج سبيل البحث في مثل هذه القضايا، وإنَّما سبقني إلى ذلک کثير من المتخصصين في درجات الماجستير والدکتوراه، ومنهم کما أوضحته في بياني وتقديمي ومن ثمَّ عرضي لبعض من الدراسات السابقة لهذا الموضوع. 
This study aims to show that the issue of family disputes is a social and natural process in married life, and there is no family in a society without its existence, but the degree of these disputes varies due to the different culture of each family as well as the different social customs and traditions prevailing in society. This study also aims to identify and analyze the types of family disputes in the Holy Quran, and ways of treating them between the Qur'anic text and the opinions of the jurists, and then in contemporary reality.
Thus, this study is an initial contribution and participation in the field of specialized studies and researches on family issues, and their religious, social, economic and intellectual cultural problems, as well as psychological and sexual ones, where they give tangible indicators of some issues related to family relations, which need to be studied and analyzed in order to analyze them and explain their reasons. And their consequent effects on the individual and the society later.
This study is based on the use of the inductive method, in the collection of scientific material, and then use the analytical method in order to clarify the issue between the Qur'anic text and the opinions of jurists, and reality.
It was determined in the results of this study that Islam has shown through the following of Qur'anic rules that the basis for the appropriate choice of each of the spouses on the basis of religion and piety and goodness substitute for the foundations that do not guarantee the marriage survival and continuity and stability only temporary living only for the stability of the family, amity, love and compassion between spouses.
The educational role of the family has also declined, and then its social role in the Muslim community and abandoning many aspects of its educational responsibility, and attention to some aspects of formality, which is the material and economic aspects.
In addition to the important findings of the study, the danger of satellite channels and modern communication networks through the media programs that spoil family and married life, and work on the dissolution of the family ties between the spouses and each other, and between spouses and the sons each other.
The scientific secretariat, I declare that I am not the first to come forward, or to seek such cases, but I have been preceded by many specialists in the master's and doctorate degrees, and as I explained in my statement and presentation and then my presentation of some of the previous studies on this subject.
The study concluded with a number of general recommendations, which I recommended at the end of my way and my journey with this study. The most important of these are the following:
First, the renewal of the religious discourse on family issues, in a sense that corresponds to the general purpose of renewing religious discourse, which is intended to activate the Qur'anic text in our daily life towards family relations.
Second: to disseminate a culture of targeted media that cares about the family, and to propose suitable solutions in the form of programs that prepare the prospective couples, as well as the couple, in order to clarify and explain this.
Third: Seeking to find social institutions that address all family problems towards scientific methodology in ways of dealing with these problems and disputes, and to address them by the civil and official efforts to get rid of them.
